The form states that the office responds within five business days, excluding weekends and holidays. That is an acknowledgment period, not a promise of production in five days. CAD entries also differ from E911 call records, which the form says are unavailable under County Law section 308(4).

An April 2026 Public Safety Committee agenda gives a dated view of local jail operations. It reported an average daily population of 31.10, a highest daily population of 34, and 137 boarded-out person-days. The same month included six Sheriff commitments, four Penn Yan Police commitments, ten centralized arraignments, and 195 visits. These are operating measures, not an annual arrest count or a county crime rate.
Small monthly counts can swing sharply, so percentages without both raw values and a clear date can mislead. The agenda also recorded 35 local or boarded transports and 17 federal transports, which further show that custody location can change. For person-level custody, use the jail phone, the Sheriff app, and a targeted official request instead.
New York Public Access Laws
The New York Freedom of Information Law gives a route to agency records, but it does not override court sealing, privacy protections, active-investigation exemptions, or a court's own access process. Ask for a defined record instead of a broad demand for “everything.” A custodian may redact protected details while releasing the rest.

The Sheriff's public request form and the county's general FOIL request center serve different custodians. Use the Sheriff form for Sheriff-created reports and the county channel for administrative records held elsewhere.
Restricted, Sealed & Expunged Records
New York generally uses the term record sealing, not expungement, for adult cases. CPL 160.50 addresses outcomes in favor of the accused. CPL 160.55 covers specified lesser outcomes. CPL 160.59 allows an application for some eligible convictions, while CPL 160.57 carries the Clean Slate automatic-sealing framework. The County Clerk also states that sexual-abuse and youthful-offender files sealed by a judge are outside its public criminal-file list.
Clean Slate took effect on November 16, 2024, but implementation is a process. OCA has up to three years to build the automatic system. Until court data transmits, a DCJS self-review may still show a conviction expected to qualify. A public no-result can therefore reflect sealing, portal coverage, timing, or name matching. It cannot prove an event never occurred.

Yates County Criminal Warrant Checks
No complete official Yates County active-warrant name portal was found. The Sheriff app advertises a Most Wanted feature, but that is not a clearance tool. Bench warrants can arise in a town or village court after a missed appearance, so the County Clerk may not hold the relevant file.
